If N passes in this situation, I have no doubt that that is based on the assumption or even knowledge that S is psyching. That can only be based on past experience, therefore an implicit, undisclosed and illegal understanding. This certainly deserves a penalty.
That the result of passing is worse than doubling or 4NT, is a form of bridge devine retribution, but that's no reason to let the passing go unpunished.

There was no previous psych of a 1NT overcall by South with this partner since they met (online) in 1999 and have played together regularly. There was a psych 17 years ago of a weak 2H by South, who held a weak 2S, and that led to the club TD (whose ruling was successfully appealed) resigning, emigrating to Australia, leaving the club and deleting all the club records from the club computer. I joke not. Pyschs cause an incredible amount of ill-feeling!

The phrase in the Laws is "repeated deviations". So sanst is both wrong and illegal.

I don't know whether this is a red psych, a green psych, a purple psych, or something else. What I do know is that any director who rules on the basis of assumption rather than investigation and accumulation of evidence is doing it wrong.
